PROMOTIONAL CAMPAIGN TERMS AND CONDITIONS
“Free 3-Month Trial Offer for HugPoint.AI Premium”
§ 1 GENERAL PROVISIONS
- The operator and organizer of the promotional campaign “Free 3‑Month Trial Offer for HugPoint.AI Premium” (hereinafter: “Promotional Campaign”) is Anton Yurkevich conducting a sole proprietorship under the business name Anton Yurkevich, with its registered office at: Mazowieckie Voivodeship, Pruszków County, Raszyn Commune, town of Rybie, ul. Wypoczynkowa 10, 05‑090, Tax ID (NIP): 5252902584, REGON: 521647422 (hereinafter: “Organizer”), who operates the service available at HugPoint.AI (hereinafter: “Service”) and the HugPoint.AI Application (hereinafter: “Application”).
- The Promotional Campaign is valid from 29.09.2025 at 00:00 until 31.12.2025 at 23:59 (hereinafter: “Promotion Period”). The Organizer reserves the right to extend the Promotion Period, about which the Company will notify by announcement published via the Service no later than 24 hours before the original end of the Promotion Period.
- The Organizer declares that the Promotion is not a game of chance, prize lottery, mutual bet, promotional lottery, game whose outcome depends on chance, or any other form provided for in the Act of 19 November 2009 on gambling games and in executive regulations to that Act.
- All terms capitalized should be interpreted according to the definitions given in the Terms available at HugPoint.AI.
- The Promotional Campaign is conditional, and the effectiveness of its execution depends on the number of people who sign up for the Promotional Campaign. If fewer than 10,000 people apply during the Promotion Period, the Organizer reserves the right to cancel the Promotional Campaign without the possibility of using the granted Reward.
- The location of the Promotional Campaign is the Republic of Poland, and participants from countries of the European Union and the Eurasian Economic Union may take part.
§ 2 GENERAL RULES OF THE PROMOTIONAL CAMPAIGN
- The Promotional Campaign is addressed to Users who, during the Promotion Period, meet all of the following conditions:
- they have never previously had an active Premium Service on any of their registered standard Accounts,
- they complete the application form for the Promotion available at https://hugpoint.ai/ (“Application Form”).
- Users who meet the conditions stated in point 1 above and activate the Premium Service under the terms set out in paragraph 4 below shall receive the ability to use the Premium Service for 3 months, counted from the day of activation, without having to pay monthly fees. Eligibility to use the Premium Service may be conditioned upon providing the Organizer with a valid and up‑to‑date payment method for use for a paid subscription afterward.
- Users meeting the conditions of § 2 para. 1 will be notified by the Organizer of the opportunity to download the HugPoint.AI Application from the official store (AppStore/Google Play) via a “Notification.” The Notification will be sent to the email address given in the Application Form.
- During the Promotion Period, participants may activate the Premium Service through a “Try Free” button provided in the email sent to them in accordance with § 2 para. 1.
- Using the Premium Service is conditional upon the User first downloading the HugPoint.AI Application from the official app store (AppStore/Google Play).
- By downloading the application the Participant accepts the terms of the HugPoint.AI Terms available at https://hugpoint.ai/terms-of-service/ and the Privacy Policy at https://hugpoint.ai/privacy-policy/.
- The Premium Service includes:
- **Hugs**
- Hugs are the basic “like” in the App and Website,
- Under the Premium Service, unlimited use of Hugs is provided,
- Hugs are sent via the “Send Hug” button on a profile card.
- **Superhugs**
- Superhugs are a highlighted “like” that increases user visibility,
- Under Premium Service, unlimited use of Superhugs is provided,
- Superhugs are sent via a separate “Superhug” button adjacent to “Send Hug.”
- **Boost Profile**
- Boost Profile allows promoting the user’s profile to the top of search results,
- Under Premium Service, unlimited use of Profile Boost is provided,
- Boost is shown in the “Boost profile” screen along with current ranking in the feed.
- **Photolink**
- Photolink is a paid carousel of user photos displayed above the map,
- Non‑paid users may add photos upon purchase of packages,
- Under Premium Service, up to 5 photos per week may be used without additional fees; beyond that, additional packages may be purchased,
- Photolink operates independently from Boost and user lists.
- **Premium Badge**
- Premium Badge is a visual marker of a Premium account shown in profile and user listings,
- Premium Badge grants access to early‑access features,
- Premium Badge is removed after subscription expiration.
- **Hugs**
- The scope of the Premium Service may change at any time, of which the User will be informed in the App or on the Website.
- After expiration of the 3‑month free Premium access, the User loses the rights to all features of the service. To continue Premium Service, the User must pay according to the then-current price list available on the Service’s website.
- The Organizer reserves the right to revoke the granted Premium access if there is suspicion of abuse of the Promotion, violation of applicable laws, or circumvention of this Promotional Campaign’s Terms or the HugPoint.AI Terms—even after the User begins using the Premium Service.
- Before the end of the free three‑month period, the Organizer may periodically send the User information about the possibility of continuing the Premium subscription for a fee.
- If the user invites others via a referral code provided after completing the Application Form, and those invited persons are not already users of the Service/App, the Participant will receive an additional 7‑day free Premium period. This is conditional upon the new user using the given code when registering a new Account and downloading and activating the App. The 7‑day access will be granted automatically without further action by the Participant.
- The Participant may use the Promotion only with one Account.
- Eligible users may use the 3‑month trial Premium offer only once—previous users cannot re‑use the offer. The Premium Service may not be available on certain personal devices.
- The Reward under the Promotional Campaign will be granted to the first 10,000 participants who meet the conditions of § 2 para. 1.
- Eligible users may use the 3‑month trial Premium offer only once.
- The Organizer reserves the right to modify or prematurely terminate the 3‑month trial Premium offer at any time and for any reason. After such time, the Organizer will have no obligation to fulfill further trial offers.
- To cancel the free Premium subscription, the user must log into the Account and follow the instructions displayed on the Account page.
- The reward may not be exchanged for anything else or redeemed for its cash equivalent.
- The Organizer is not liable for incorrect personal data submitted by the Participant that prevents identifying the Participant.
§ 3 PROCESSING OF PERSONAL DATA
- The data controller of Participants’ personal data is Anton Yurkevich conducting a sole proprietorship under the business name Anton Yurkevich, with its registered office at: Mazowieckie Voivodeship, Pruszków County, Raszyn Commune, Rybie, ul. Wypoczynkowa 10, 05‑090, NIP: 5252902584, REGON: 521647422 (“Administrator”).
- For all matters concerning processing of Participants’ personal data, the Participant may contact the Administrator by e‑mail at support@hugpoint.ai.
- Processing of the Participant’s personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) for the purpose of conducting and settling the Promotional Campaign, handling complaints, and awarding the promotional benefit. The legal basis is Art. 6(1)(b) and (f) GDPR, including sending marketing information about continuing the Premium subscription for a fee. Where processing is required by mandatory laws (e.g., tax laws), the legal basis is Art. 6(1)(c) GDPR.
- Personal data will be processed by the Administrator for the period necessary to conduct and settle the Promotional Campaign, but not longer than 6 months after the end of the Campaign. The Administrator will retain personal data under applicable tax laws (if relevant to the Campaign) for up to 5 years from the end of the tax year in which the Campaign ended.
- Personal data may be shared with entities to whom the Administrator has entrusted or subcontracted data processing, including postal or courier services, accounting, legal or IT service providers, and public authorities.
- Providing personal data is voluntary yet necessary for participation in the Promotional Campaign.
§ 4 COMPLAINT PROCEDURE
- All complaints related to the Promotional Campaign must be submitted in writing within 14 days from the date of the event forming the basis of the complaint to: support@hugpoint.ai.
- The complaint should include at least: the name and email of the complainant (registered to the Service), circumstances justifying the complaint, and the request of the complainant.
- If the submitted data or information does not permit recognition of the complaint, the Organizer will request the complainant to clarify doubts or provide additional information necessary to assess the complaint, specifying the needed data.
- The Organizer will notify the complainant of the outcome via email to the address provided.
- The Promotional Campaign cannot be combined with other promotions, discounts, or special offers by the Organizer unless the terms of those promotions provide otherwise.
- The Organizer is entitled to amend these Terms in case of:
- changes in law affecting its business, necessitating adjustments to these Terms;
- need to enhance participant safety or prevent abuses related to the Promotion or use of the Service/App;
- need to improve data protection, Service features, or introduction/removal of functionalities;
- changes to the Service’s Terms that affect the rules described here.
- Changes become effective no sooner than 3 days after publication of the amended terms. Information on changes will be available at: https://hugpoint.ai/promo-terms/.
- The Organizer may terminate the Promotional Campaign early in case of repeated Terms violations by participants, and will inform via the Service’s website.
§ 5 MINIMUM TECHNICAL REQUIREMENTS
- To use the Website and the HugPoint.AI Application, the following are required:
- a mobile device (smartphone or tablet) with internet access,
- active internet connection (Wi‑Fi or mobile data; 3G/LTE with 4G/5G recommended),
- enabled and operational GPS/location modules and (optionally) Bluetooth,
- Minimum requirements for the mobile app:
- Android operating system version 10.0 (Q) or newer,
- iOS operating system version 15.0 or newer,
- at least 3 GB of RAM,
- at least 200 MB of free storage for the app and data,
- screen resolution at least 720 × 1280 pixels.
- Minimum requirements for using the website:
- a current version of Chrome, Safari, Firefox, or Edge,
- support for cookies and JavaScript.
- For proper functionality of features such as map, SOS, or real‑time meeting scheduling, consent to device location access is required. Lack of consent may limit the App or Website’s functionality.

I confirm that I have read the information contained in §3 of the Terms and Conditions of the Promotional Campaign, constituting the fulfillment of the information obligation under Article 13 of the GDPR, regarding the processing of my personal data, and I am aware of all the rights granted to me under Articles 15–19 and 21 of the GDPR.
I acknowledge that I have been informed of my statutory right to withdraw from the agreement for access to the Premium Service without providing any reason within 14 days from the date of its conclusion. The rules of withdrawal, including a template withdrawal form that the User may use, are provided below.

To meet the deadline, it is sufficient to send your withdrawal notice before the 14-day period expires.
